Commercial Property Solicitors Provide Support During Real Estate Transactions

Commercial property solicitors assist with real estate transactions involving non-residential land or buildings. People hire a solicitor for a variety of proceedings, including transactions, title searches, foreclosures, and litigation. Examples of cases may include contract disputes, zoning issues, or other real estate litigation. Lawyers may work in a variety of settings, from law firms to large corporations.

Most commonly, lawyers assist with transactions involving land or buildings. Lawyers provide opinions on whether clients should purchase land or buildings, based on their suitability for development. If clients do make a purchase, lawyers will handle the closing, and provide any information related to unpaid taxes.

Lawyers may be asked for opinions concerning titles. For instance, lawyers will check a title history, find out if any liens exist, and take care of paperwork for the insurer. Lawyers want to ensure that land or buildings have clear title, to protect their clients from unexpected expenses.

Lawyers may manage mortgage disputes and foreclosure. A mortgage company or broker may need a lawyer to settle disputes between buyers and lenders. For example, lawyers may handle correspondence regarding loan defaults, file paperwork for the court, or follow up on late loans. Investors may also hire lawyers, when purchasing short sales, foreclosures, or any type of distressed real estate.

Clients may also need lawyers to represent them in court. For their clients, lawyers prepare requested documents, draft legal complaints, and answer questions. When cases make it to court, lawyers present their clients' arguments to the jury and the judge. Examples of real estate litigation include investors suing developers, or tenants suing landlords.

Lawyers may be employed by a law firm, or by a large corporation. If working for a large corporation, then lawyers often serve as general counsel, filing paperwork for taxes and incorporation, as well as for acquisitions.
